Services Offered
NickTrep Design provides professional design services, including but not limited to graphic design, web design, and custom product design. Our services are subject to the signing of contracts and non-disclosure agreements (NDAs) with some clients, especially for projects requiring confidentiality.
Eligibility
You must be at least 18 years of age to use our services. By agreeing to these Terms, you represent and warrant that you are of legal age and capable of entering into a binding contract.
Contracts and Non-Disclosure Agreements
For certain services, clients may be required to enter into additional agreements, including service contracts and NDAs. These agreements will be provided to the client prior to the commencement of any work and are considered part of these Terms.
Payment Terms
Services provided by NickTrep Design are subject to payment. Payment terms, including rates, invoicing, and payment schedules, will be specified in the individual service contract or agreement.
Cancellation and Refunds
Clients may cancel services with written notice to NickTrep Design. Any payment made for work already performed or expenses incurred by NickTrep Design up to the point of cancellation will be non-refundable. Specific refund policies may be outlined in the individual service agreement.
Intellectual Property Rights
Unless otherwise agreed upon in writing, NickTrep Design retains all rights to the designs, artwork, and any other deliverables created as part of our services. Clients are granted a non-exclusive, non-transferable license to use the deliverables as specified in the service agreement.
Termination
NickTrep Design reserves the right to terminate or suspend access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
Limitation of Liability
NickTrep Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from the use or inability to use the service.
Dispute Resolution
Any disputes arising under or in connection with these Terms of Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, and the venue for such arbitration shall be California.
